DESCRIPTION:UCL Centre for Law and Environment is launching Professor Richard Macrory’s new book Irresolute Clay: Shaping the Foundations of Modern Law\n\n\n\nWith the huge uncertainties around reopening of normal business with the coronavirus\, we feel that it is prudent to postpone the Book Launch “Shaping Environmental Modern Law” with Professor Richard Macrory and Lord Carnwath on Tuesday 23 June. \nWe will reschedule this event\, hopefully for the autumn 2020\, when we will have a better understanding of the effects of government guidance (when it comes!) on public events.  \n—- \nUCL Centre for the Law and Envronment is pleased to host the launch of Professor Richard Macrory’s new book Irresolute Clay: Shaping the Foundations of Modern Law.  \nThis free event will take the form of a conversation with Richard and Lord Carnwath about issues raised in the book to be followed by an informal reception.  \nCopies of the book will be available for those attending for purchase at £20 (a 20% discount \nAbout the Book\nAt a time of profound change and rethinking\, this book provides insights into how environmental law in the UK has developed into its current form\, and considers challenges it will face in the future. Irresolute Clay is not a legal history or texbook\, nor a conventional set of legal memoirs. Instead it offers a personal account of the inside stories as experienced by one of the key architects of contemporary environmental law. Taking a thematic appraoch\, it charts fundamental tenets of the subject (such as environmental sanctions\, the European dimension\, developing the academic discipline of environmental law\, and environmental courts and tribunals)\, from the beginnings of the modern environmental law era in the 1970s to the present day. \nSupported by Harts Law Books and UK Environmental Law Association \nAbout the Speakers\nProfessor Richard Macrory joined the Faculty in 1999. He had previously been teaching at Imperial College London\, and was Director of the Environmental Change Institute\, Oxford University. Richard Macrory was a Member of the Royal Commission on Environmental Pollution between 1992 and 2003\, and was a Board Member of the Environment Agency in England and Wales between 1999 and 2004. He was the founding editor in chief of the Journal of Environmental Law (Oxford University Press) and is currently legal correspondent to ENDS Report. He was Hon. President of the National Society for Clean Air 2005-6\, and chairman of Merchant Ivory Film Productions between 1988 and 2004. In 2001-2003 he was elected chairman of the Steering Group of the European Environmental Advisory Councils\, an informal network of official environmental advisory bodies throughout Europe. Professor Macrory is a Patron of the UK Environmental Law Association. \nLord Carnwath of Notting Hill became a Justice of The Supreme Court in April 2012. After studying law at Trinity College\, Cambridge\, Lord Carnwath was called to the Bar (Middle Temple) in 1968 and took silk in 1985. He served as Attorney General to the Prince of Wales from 1988 to 1994. He was a judge of the Chancery Division from 1994 to 2002\, during which time (1999 to 2002) he was also Chairman of the Law Commission. Lord Carnwath was appointed to the Court of Appeal in 2002. Between 2007 and 2012 he was Senior President of Tribunals and led the planning and implementation of the reforms of the tribunal system following the Leggatt report.

This will be followed by an interactive discussion about the relevant capabilities that construction professionals/firms could consider exploring in order to remain relevant and competitive in a digitally enabled and OSM-driven environment for project delivery. \nSPEAKER \nDr Kwadwo Oti-Sarpong  BSc PhD  \nResearch Associate | University of Cambridge \nDr Kwadwo Oti-Sarpong is a Research Associate at the Cambridge Centre for Housing and Planning Research\, Department of Land Economy\, University of Cambridge. He is part of a team investigating the non-technical inhibitors to an industry-wide uptake of digital technologies in the construction industry. His research seeks to understand why digital approaches have not yet become mainstream despite their widely acknowledged benefits\, and to make suggestions as to how industry-wide changes can be made. Additionally\, the research explores how emerging digital technologies can be integrated with off-site manufacturing (OSM) to increase the potential for widespread uptake in the UK construction industry. \nInspired by his interest in construction technology and its application in project settings\, Kwadwo studied for a PhD in the Department of Real Estate and Construction\, University of Hong Kong (HKU). He used the social construction of technology (SCOT) approach to explore the complex interactions embedded in a project-based technology adoption processes in a new environment.  \nHe previously worked as a Post-Doctoral Researcher at Hong Kong University where he investigated how small and medium construction firms were responding to a government mandate for compulsory building information modelling (BIM) use on all public works projects. DESCRIPTION:Book Launch for: ‘Between Impunity And Imperialism: The Regulation Of Transnational Bribery’ by Kevin E. Davis\n\n\n\nTickets will be released from 09.00 on Friday 3 April. \nWhen people pay bribes to foreign public officials\, how should the law respond? This question has been debated ever since the enactment of the U.S. Foreign Corrupt Practices Act of 1977\, and some of the key arguments can be traced back to Cicero in the last years of the Roman Republic and Edmund Burke in late eighteenth-century England.  \nIn recent years\, the U.S. and other members of the OECD have joined forces to make anti-bribery law one of the most prominent sources of liability for firms and individuals who operate across borders. The modern regime is premised on the idea that transnational bribery is a serious problem which invariably merits a vigorous legal response. The shape of that response can be summed up in the phrase “every little bit helps\,” which in practice means that: prohibitions on bribery should capture a broad range of conduct; enforcement should target as broad a range of actors as possible; sanctions should be as stiff as possible; and as many agencies as possible should be involved in the enforcement process. An important challenge to the OECD paradigm\, labelled here the “anti-imperialist critique\,” accepts that transnational bribery is a serious problem but questions the conventional responses.  \nThis book uses a series of high-profile cases to illustrate key elements of transnational bribery law in action\, and analyzes the law through the lenses of both the OECD paradigm and the anti-imperialist critique. It ultimately defends a distinctively inclusive and experimentalist approach to transnational bribery law. \n \nAbout the Speakers \nKevin E. Davis is Vice Dean and Beller Family Professor of Business Law at New York University School of Law. His current research focuses on contract law\, anti-corruption law\, and the general relationship between law and economic development. Before entering academia\, Professor Davis served as Law Clerk to Justice John Sopinka of the Supreme Court of Canada and was an associate in the Toronto office of Torys\, a Canadian law firm. From 1996-2004 he was an assistant and then an associate professor at the University of Toronto. He also has held visiting positions at the University of Southern California\, Cambridge University’s Clare Hall\, the University of the West Indies (Cave Hill)\, Fundação Getúlio Vargas\, São Paulo and the University of Toronto.   \nJeremy Horder is Professor of Criminal Law at The London School of Economics. His research interests include history\, philosophy and politics of English criminal law\, and criminal law reform\, more particularly\, homicide\, bribery and corruption\, and the intersection of criminal law and other forms of sanction. Professor Horder was a Research Fellow at Jesus College\, Oxford\, from 1987-1989\, and the Porjes Trust Tutorial Fellow in Law at Worcester College\, Oxford\, from 1989-2010. He was Chairman of Oxford’s Faculty of Law from 1998-2000. From 2005-2010\, he was a Law Commissioner for England and Wales\, with responsibility for criminal law reform\, before becoming Edmund Davies Professor of Criminal Law at King’s College London\, from 2010-2013. He is an Honorary Bencher of the Middle Temple and holds an Honorary LL.D from the University of Hull. \nJames Mather is a barrister at Serle Court. He won ‘Insolvency Junior of the Year’ at the Legal 500 Bar Awards 2018.  His areas of expertise include insolvency\, partnership and shareholder disputes; commercial fraud and asset recovery; and domestic and offshore trusts matters. Recent significant cases include two sets of proceedings arising out of the corrupt sale of Formula One; the leading Court of Appeal authorities on\, respectively\, the law of privilege in personal insolvency and the threshold test for obtaining security for costs; and a Privy Council decision on a novel point of BVI company law and a Commercial Court decision on the scope of the court’s power to grant urgent injunctive relief in support of arbitration proceedings. \nAlun Milford is a highly experienced criminal lawyer. He specialises in serious or complex financial crime\, proceeds of crime litigation and corporate investigations. He has particular knowledge and experience of issues surrounding corporate crime and deferred prosecution agreements. He joined Kingsley Napley from the public sector where\, over a twenty-six year career as a government lawyer and public prosecutor\, he worked in a wide variety of roles including General Counsel at the Serious Fraud Office\, the Crown Prosecution Services’ Head of Organised Crime\, its Head of Proceeds of Crime and Revenue and Customs Prosecutions Office’s Head of Asset Forfeiture Division. He also worked as a prosecutor in central London and a lawyer in the Attorney General’s Office. \n \nAbout the Chair \nPrabha Kotiswaran is Professor of Law & Social Justice at King’s College London. Her main areas of research include criminal law\, transnational criminal law\, sociology of law\, postcolonial theory and feminist legal theory. DESCRIPTION:Rethinking Derivatives Regulation – Steven L. Schwarcz\n\n\n\nAbstract: \nThe conventional wisdom is that derivatives are exotic and uniquely risky\, although innovative\, financial instruments. That perception has given rise to a regulatory patchwork described as confusing\, incomplete\, and contradictory. This lecture will rethink how derivatives should be regulated. It will begin by de-mystifying derivatives. In contrast to the arcane industry-derived categories\, the lecture will show that derivatives can be deconstructed more intuitively\, by their economic functions\, into two categories of traditional legal instruments—option contracts and guarantees. Being neither exotic nor uniquely risky\, most derivatives should be regulated like those traditional instruments. The lecture then will explain why at least one subset of guarantees—financial guarantees with systemically important counterparties\, which are epitomized by credit-default swap (CDS) derivatives—can seriously threaten economic stability\, and why the absence of an insurable-interest requirement can further magnify that threat. Finally\, the lecture will examine how to design regulation that efficiently targets that threat. \nBio: \nSteven L. Schwarcz is the Stanley A. Star Professor of Law & Business at Duke University and Founding Director of Duke’s interdisciplinary Global Capital Markets Center (now renamed the Global Financial Markets Center). His areas of research and scholarship include insolvency and bankruptcy law\, international finance\, capital markets\, systemic risk\, corporate governance\, and commercial law. He holds a bachelor’s degree in aerospace engineering (summa cum laude) and a Juris Doctor from Columbia Law School. DESCRIPTION:Rochelle Cooper Dreyfuss is the Pauline Newman Professor of Law at New York University.\n\n\n\nPauline Newman Professor of Law\, New York University School of Law \nArthur Goodhart Visiting Professor in Legal Science\, University of Cambridge \nAbstract: \nBilateral investment treaties (BITs) have typically allowed investors to submit to arbitration claims that the host state has\, directly or indirectly\, expropriated their assets or denied them fair and equitable treatment.  For some time\, observers have expressed concerns that investor-state dispute settlement (ISDS) chills sovereign regulatory authority.  However\, two recent intellectual property disputes\, both involving state action to protect health and access to medicine\, have brought the potential impact of ISDS on social welfare to the fore.  As a result\, states are now reconsidering the terms on which they are willing to offer investment protection.  A survey of BITS signed in 2019 reveals that some states have withdrawn entirely from dispute settlement.  Others are making less extreme modifications\, including procedural changes\, express acknowledgement of the state’s right to regulate\, and substantive limitations on the bases on which claims can be brought. Some agreements tackle the problem of health (or more generally\, IP-related) regulation specifically.  In this workshop these strategies will be evaluated to determine the extent to which they reduce regulatory chill in the IP realm. \nBio: \nRochelle Cooper Dreyfuss is the Pauline Newman Professor of Law at New York University School of Law and the co-director of the Engelberg Center on Innovation Law and Policy. She holds BA and MS degrees in chemistry and spent several years as a research chemist before entering Columbia University School of Law\, where she served as articles and book review editor of the Law Review. She was a member of the National Academies’ Committee on Science\, Technology\, and Law\, the Secretary of the Department of Health and Human Services’ Advisory Committee on Genetics\, Health\, and Society\, and a consultant to the Federal Courts Study Committee\, the Presidential Commission on Catastrophic Nuclear Accidents\, and the Federal Trade Commission. She has edited several books on intellectual property\, including Balancing Wealth and Health: The Battle Over Intellectual Property and Access to Medicines in Latin America (2014\, with César Rodríguez-Garavito)\, which was published in 2016 in Spanish as Entre la salud y las patentes. She co-authored A Neofederalist Vision of TRIPS: Building a Resilient International Intellectual Property System (2012\, with Graeme Dinwoodie). The session will examine the persistence of global poverty and inequality within the framework of the SDGs\, and consider the role of the law and legal institutions in supporting international development efforts. \nAfter an initial introduction to the SDGs\, participants will learn how promoting socio-economic rights can help to alleviate poverty\, and in particular\, the importance of land rights in addressing global hunger. \nSpeakers will include Farooq Ullah\, Stakeholders Forum and Ruth Kelly\, University of York \nModule Two: Peace and the Rule of Law \nSunday  9 February 2020 \nModule two examines how strengthening the rule of law helps to promote peace and stability in developing countries. Michael Woolcock of the World Bank will discuss the need for strong\, accountable and transparent institutions in developing countries to uphold the rule of law. Meanwhile\, Dr Sarah Bracking of Kings College London\, will analyse the impact of political corruption on peace and development. \nParticipants will study how corruption drains vital financial resources\, which might otherwise fund economic and social development\, and analyse the modern meaning and manifestations of corruption\, as well as the impact of corrupt regimes and corrupt private sector actors on achieving the SDGs. \nSpeakers include Michael Woolock\, World Bank and Dr Sarah Bracking\, Kings College London \nModule Three: Putting People First – Legal Mechanisms to Reduce Inequalities \nSaturday 7 March 2020 \nModule three addresses the legal and development challenges in realising the different SDGs that directly relate to people: health\, education\, gender equality and access to clean water. The session will highlight the legal frameworks that can help to reduce inequalities in terms of access to health\, quality education and clean water and sanitation\, as well as legislation to enforce gender equality. \nThe first speaker\, Robert Yates of Chatham House will examine the legal determinant of health and the provision of universal health coverage. Peter Newborne of the Overseas Development Institute will then review the three principal legal tools for formulating access to water rights\, and consider the practicalities of bringing water infrastructure and access to marginalised communities in a low income country. \nEquality Now’s Jacqui Hunt will discuss gender equality in law and practice\, drawing on the NGOs advocacy experience\, followed by Delphine Dorsi of Right to Education\, who will explain the critical role of the right to education in sustainable development. \nSpeakers include Robert Yates\, Chatham House\, Peter Newborne\, Overseas Development Institute\, Jacqui Hunt\, Equality Now and Delphine Dorsi\, Right to Education  \nModule Four: Business and Human Rights – Prosperity for All \nSaturday 28 March 2020 \nIn areas with weak regulation\, large-scale construction projects can result in significant environmental and social damage\, with no recourse to justice for those harmed. This module will explore the Equator Principles\, which were developed by the International Finance Corporation to manage and mitigate the social and environmental risks of projects and to promote responsible development. \nAlongside the Equator Principles\, the UN Human Rights Council adopted the UN Guiding Principles on Business and Human Rights (UNGPs) in 2011\, which have become the key reference for human rights conduct by companies globally. Being a soft law tool in nature\, the UNGPs triggered several hard law regulations to be adopted by several EU member states\, Australia\, and partly the US in the recent years. \nThe module will depict key developments and trends in the field of business and human rights internationally and use a practical case study to consider how human rights issues arise in the course of business. Participants will be encouraged to think about how lawyers can assist businesses to manage their human rights risks\, whilst taking into account their own professional\, legal and ethical responsibilities. \nSpeakers include Helena Anderson\, Ikigai Capital\, Isabel Ebert\, University of St Gallen\, and Anna Kirkpatrick\, Clifford Chance \nModule Five: The Role of Law in Protecting our Environment \nSaturday 25 April 2020 \nThe UN climate change negotiations are amongst the most complex multilateral law and policy processes ever. Some developing countries lack the legal and technical capacity to participate meaningfully and effectively in those negotiations. \nThis practical module will consider how the demands of developed and developing countries may differ\, and explore the role that lawyers can play in enabling negotiations\, and in particular assist countries that are most vulnerable to climate change\, yet often least equipped to cope. \nThe Paris Agreement set ambitious goals for global climate policy but national and regional policy and business and investment strategies need to align with these goals to make them happen. This module will also will look at how law can be used to drive the integration of climate-related financial risks into business and investment decisions\, as well as legal opportunities to promote a circular economy. \nSpeakers include Pascale Bird\, Legal Response Initiative\, Joanne Etherton\, ClientEarth and Maya de Souza\, UK Department for Environment\, Food & Rural Affairs \nModule Six: Using the Law to Promote Sustainable Partnerships and Finance Development \nSaturday 16 May 2020 \nThe World Trade Organisation has been instrumental in trade liberalisation and globalisation\, but its critics highlight the disproportionate benefits that have flowed to rich\, developed countries and the marginalisation of the least developed. This module will focus on the trade system and how it impacts on sustainable development. \nIn addition\, the module will explore why tax is fundamental for development and will outline what is being done to implement effective systems for tax collection and to close the mechanisms which enable tax avoidance and evasion. \nFinally\, participants will learn about the link between debt crises and development\, as well as the opportunities and challenges that private sector technology presents for sustainable development. \nSpeakers include James Scott\, Kings College London\, John Christensen\, Tax Justice Network\, and Tim Jones\, Jubilee Debt Campaign \nModule Seven: The Sustainable Development Goals and Pro Bono in Practice \nSaturday 6 June 2020 \nSituating pro bono legal assistance within an international development context\, the final module of the programme will encourage participants to think about how they can develop more impactful pro bono projects that respond to the environment that they are operating in. \nDrawing on the technical expertise of A4ID’s ROLE UK Programme\, this module will introduce participants to a variety of development tools\, including theories of change\, the COM-B model for stimulating behaviour change among a target group\, and monitoring and evaluation frameworks\, which allow practitioners to measure the effectiveness of their pro bono assistance and build on the lessons learnt to improve future efforts. \nParticipants will also hear from Pro Bono Managers who have already begun to integrate the SDGs into their work.
